GENERAL CONDITIONS OF CONTRACT AND CANCELLATION

1. Definitions.

"Booking": the purchase number issued by or on behalf of the company, which gives the right to make the tourist flight chosen by its owners.

“LNA”: are the acronym of Law 48/1960, of July 21, on Air Navigation.

“ICAO”: is the acronym for the International Civil Aviation Organization.

“Helitaxi”: air transportation between the departure airport and the destination airport.

“Tourist flight”: flight with the same aerodrome or heliport of departure and destination.

"Company": company whose activity is air transport.

"Applicant": person making the reservation.

“Passengers”: people who make the flight.

"Passage": group of passengers who make the flight having a unity character in the reservation and in the flight.

 

2. Object. The purpose of this contract is to regulate the terms and conditions under which the Company will carry out the tourist or Helitaxi flights specified in the reservation and present, where appropriate, other related services. Without prejudice to the provisions of these General Conditions, all transportation carried out and other services provided by the Company will be subject to:

(i) the provisions contained in the reservation,

(ii) the applicable rates,

(iii) the related regulations that are part of this Contract and that, if applicable, may be consulted at the Company's offices,

(iv) the regulations that are applicable at all times.

 

3. Reserve. The reservation will be valid only for the flight indicated in it, and it is necessary that the flight corresponds to the one booked.

3.1 Requirements for reservation: The flight reservation is confirmed when the Company issues the reservation, and no subsequent confirmation of the flight is necessary.

3.2 Changes to the reservation:

– Changes to the reservation must be made at least three (3) days in advance of the start of the flight. No changes will be accepted after three days.

– The change of date of the contracted service will be allowed as long as the new proposed day is within 6 months after the flight date of the initial reservation.

– Reservations with offers and discounts cannot make date changes.

– No changes can be made regarding the departure or destination points.

– Changes may be made to the reservation regarding service holders on the day of the flight.

3.3 Cancellation of the reservation: Cancellation of the flight by the applicant will not entail any refund or compensation from the Company.

3.4 Payment: The price of the reservation, as well as taxes, fees, management charges, and any other amounts related to the reservation, must be paid in full at the time of confirming the reservation. If said payment is not verified, it will be understood that the contract has not been concluded and these conditions will not apply.

 

4. Prices.

4.1 General: The reservation price does not include the ground transportation service, except when the Company expressly offers it. The reservation price will be the one set by the Company at any time.

4.2 Taxes and fees: The Company will add to the price of the reservation the taxes and fees established by the competent authority at all times, which will be borne by the passenger. These taxes and fees are subject to modifications beyond the control of the Company, which may occur after making the reservation.

4.3 Non-use of the flight: Except as stipulated in these conditions, the passenger's non-use of the contracted flight at the corresponding time will not generate any obligation for the Company to return or reimburse the reservation, its fees, management expenses, taxes or any other amount. paid by the applicant to the Company related to the contracted flight, nor any other compensation or indemnity.

5. Limitations in airspace.

5.1 There are limitations when flying over inhabited areas with more than 50,000 inhabitants. In these cases the flight is limited to making a circumambulation of the chosen town in order to respect current regulations.

5.2 At all times, strict observation of the limitations in the airspace established regularly by the competent authority and those declared by Law or Regulation will be maintained.

5.3 Special attention will also be paid to the limitations in airspace that are exceptionally established by the competent authority. In these cases, and with a reservation already formalized, a consensus date will be sought to carry out the flight.

 

6. Schedules, delays, diversions, substitution, cancellation of flights and passengers not admitted to boarding.

6.1 Schedules: At any time after booking a flight, the Company may change the schedules and/or cancel, terminate, divert, postpone, or delay any flight if, in the opinion of the captain, this is done with justified cause or for reasons of security.

6.2 Delays: If the Company foresees a delay of a flight with respect to the departure time of more than three hours, the applicant may suspend the flight without any cost.

6.3 Detours: In the event that it is necessary to divert the flight, the Company will be in charge of proposing new alternatives, without any additional cost.

6.4 Replacement of flights: If it is considered necessary, the Company is authorized to be replaced by other Companies, as well as to use helicopters other than those initially planned to operate the exchange.

6.5 Flight cancellation: In any case, the Company will not be obliged to pay any compensation to the passenger or the applicant when the cancellation has been caused by adverse weather conditions, war, acts of terrorism, acts of God, altercation, demonstrations and any other matter of public order, problems technical problems affecting the aircraft, and failures in air traffic control, fires, floods, earth movements, earthquakes, natural disasters, epidemics and other restrictions caused by a declaration of quarantine, acts derived from a competent authority, strikes and in addition labor problems, failures in supplies from suppliers or subcontractors, and any other extraordinary circumstance that could not have been avoided even if reasonable measures had been taken. Likewise, the Company will not be obliged to pay compensation when it has reported the cancellation of the flight at least one day in advance of the scheduled departure time.

 

7. Compensation, reimbursement, alternative transportation and care measures. Compensation measures: in cases arising as a result of adverse weather conditions, war, acts of terrorism, acts of God, altercation, demonstrations and any other issue of public order, technical problems affecting the aircraft, and failures in traffic control air, fires, floods, earth movements, earthquakes, natural disasters, epidemics and other restrictions caused by a declaration of quarantine, acts derived from a competent authority, strikes and also labor problems, failures in supplies from suppliers or subcontractors , and any other extraordinary circumstance that could not have been avoided even if reasonable measures had been taken, passengers/applicants will have the right to change the day or have the reservation refunded.

 

8. Luggage.

8.1 General: The ticket must be limited to the technical characteristics of the contracted helicopter.

8.2 Hand luggage: Passengers may carry binoculars with them in the aircraft cabin. These conditions are subject to space availability.

8.2 Animals: The Company does not accept animals.

9. Right of the Company to deny transportation to passengers and restrictions on transportation.

9.1 Right of the Company to deny transportation to passengers: The captain reserves the right to deny, at any time, the flight of a passenger who has a valid reservation, at the discretion of the Company:

(i) It is necessary or convenient for security reasons.

(ii) It is necessary or convenient due to the conduct, state, age or physical mental condition of the passenger.

(iii) It is necessary or convenient to avoid harm, discomfort or inconvenience to other passengers or the crew.

(iv) It is necessary or convenient because the passenger has failed to comply with the Company's rules.

(v) The passenger has presented to the Company any document acquired illegally, that has been reported lost or stolen, or that is allegedly false or contains modifications or alterations of any kind not made by the Company. In these cases, the Company reserves the right to retain said documents.

(vi) The people who appear at the Company's counter do not correspond to the holders of the reservation. In this case, the commander reserves the right to withhold said reservation.

9.2 Transportation restrictions: boarding is not permitted to:

(i) The Company will not accept as passengers children under 14 years of age who are not accompanied by a passenger over 16 years of age (who has family ties), who will assume full responsibility for the minor. The companion must be included in the same reservation.

(ii) The Company will not accept passengers who suffer or may be suffering from serious infectious diseases, such as severe respiratory infections, tuberculosis, or pneumonia. (iii) the Company will not accept a ticket whose average weight exceeds 80 kg per passenger.

 

10. Conduct on board the aircraft.

10.1 If, in the opinion of the Company, the conduct of the passenger on board the aircraft may endanger the aircraft or any person or property on board the aircraft, or represents an obstacle to the crew performing their duties, or ignores ignores any instructions by the crew, or threatens, abuses or insults any member of the crew, or behaves in a scandalous or other manner that may be considered offensive towards the rest of the passengers, the Company may take measures that it deems necessary. to prevent such behavior from continuing, including moderate physical coercion or disembarkation from the aircraft.

10.2 If the Company decides, in the reasonable exercise of its discretion, to divert the aircraft in order to disembark the passenger, the passenger must pay the Company all expenses and costs arising from said diversion.

10.3 Unless expressly permitted by the Company, it is prohibited for safety reasons to use any type of electronic device or similar device on board an aircraft. The equipment and devices whose use is prohibited are, among others and without limitation, portable radios and recorders, mobile phones, laptop computers, audio cassette players, compact discs, DVDs and/or MP3s, electronic games and transmission devices ( including remote control toys and portable transceivers).

10.4 The consumption of alcoholic beverages is not allowed.

BOARDING INSTRUCTIONS

– The passenger must arrive 20 minutes before the scheduled flight time to the origin heliport that appears in the reservation.

– The passenger will carry the reservation with its corresponding purchase number and ID with photo.
